Australia Tightens ESOS Act to Combat Student Exploitation

The Australian Government is set to bolster the integrity of its international education sector. Amendments to the Education Services for Overseas Students (ESOS) Act 2000 are planned to combat student exploitation and migration system abuses. While no specific implementation date is available, the Government has confirmed its commitment to strengthening the sector in 2025-26.

The ESOS Act, currently regulating international education, will undergo changes to enhance student rights and provider responsibilities. Despite no official amendment timelines disclosed, the Government assures the sector that updates are forthcoming.

To shape future policy and regulatory settings, the Government will engage with stakeholders, developing a long-term strategy in consultation with the sector. Ministerial Direction 111, introduced in 2024, will continue to focus on genuine students and providers, ensuring sustainable student numbers.

Contrary to previous considerations, the Government has decided against implementing enrolment caps through the ESOS Act. Instead, it will explore alternative avenues to manage student numbers.

The Australian Government's planned amendments to the ESOS Act aim to fortify the integrity of the international education sector. With stakeholder engagement and a focus on genuine students and providers, the Government is committed to a sustainable and robust sector in the long term.
